1. Introduction & Acceptance
These Terms & Conditions ("Terms") govern your access to and use of the Koda Markets trading platform, websites and related services (collectively, the "Platform"). By creating an account, accessing or using the Platform, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Eligibility
You must be at least 18 years of age (or the age of legal majority in your jurisdiction) and legally permitted to enter into binding contracts. You are responsible for ensuring that your use of the Platform is lawful in your country of residence. The Platform is not directed at residents of any jurisdiction where its use would be contrary to local law or regulation.
3. Nature of the Service & Risk Warning
CFDs (Contracts for Difference) are complex leveraged instruments and carry a high risk of losing money rapidly. Trading on leverage can result in losses that exceed your deposits. Past performance is not indicative of future results. Nothing on the Platform constitutes investment, legal or tax advice. You trade entirely at your own risk and should seek independent advice where appropriate.
4. Demo & Live Accounts
The Platform provides Demo accounts funded with virtual credits for practice purposes, and Live accounts which may hold real funds where supported. Demo balances have no monetary value, may be reset at any time, and do not reflect real market execution conditions such as slippage or liquidity. Profits or losses on a Demo account are simulated and are not payable.
5. Account Registration & Security
You agree to provide accurate, current and complete information during registration and to keep it updated. You are solely responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorised access. We may suspend or terminate accounts that provide false information or breach these Terms.
6. KYC, AML & Verification
To deposit, withdraw or access certain features you must complete identity verification (KYC), which may require government-issued identification and proof of address (a 100-point identification standard). We comply with applicable Anti-Money-Laundering (AML) and Counter-Terrorism-Financing regulations and may request additional documentation, delay or refuse transactions, and report activity to relevant authorities where required.
7. Deposits, Withdrawals & Payments
Deposits to Live accounts are processed via our payment providers. Withdrawals are subject to verification, anti-fraud checks and applicable processing times, and may be returned to the original funding source. We do not extend credit and are not a deposit-taking institution. You are responsible for any taxes arising from your trading activity.
8. Order Execution & Pricing
Prices are sourced from third-party market data feeds and may differ from prices available elsewhere. We make reasonable efforts to provide accurate, timely data but do not guarantee it is error-free or uninterrupted. Orders, including stop-loss, take-profit and limit orders, are executed on a best-efforts basis and may be subject to gaps, slippage or rejection.
9. Prohibited Conduct
You agree not to: use the Platform for unlawful purposes; exploit errors, latency or pricing mistakes; use automated abuse, manipulation or arbitrage schemes; circumvent risk controls; or interfere with the integrity or security of the Platform. We may void trades and close accounts engaged in abusive or fraudulent activity.
10. Funded Trader Program
Participation in any evaluation or funded-trader program is subject to additional program rules, including profit targets, drawdown limits and minimum trading days. Evaluation fees are for access to the assessment and are generally non-refundable once an evaluation begins, except as required by law or stated in the specific program terms.
11. Intellectual Property
All content, trademarks, software and materials on the Platform are owned by Koda Markets or its licensors and are protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for personal, non-commercial purposes only.
12. Limitation of Liability
To the maximum extent permitted by law, Koda Markets shall not be liable for any indirect, incidental, special or consequential losses, or for any loss of profits, data or trading opportunities, arising from your use of or inability to use the Platform. The Platform is provided "as is" and "as available" without warranties of any kind.
13. Suspension & Termination
We may suspend, restrict or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms, applicable law, or to protect the Platform and its users.
14. Amendments
We may update these Terms from time to time. Material changes will be notified through the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
